Baffert’s attorney, Clark Brewster, said: “The complaint was sent as a focus of discussion. It was intended to provoke an honest discussion and avoid litigation. There is nothing wrong with complaining. The facts are in our corner. It has been dismissed and they have called for litigation, and that’s where we’ll be.”

He did not say when or where the complaint was lodged.

At the Sham Stakes Jan. 1 at Santa Anita Park, Colts Newgrange and Rockefeller coach Baffert ran first and second. However, Churchill Downs refused to award points to any horses trained by Baffert.

Baffert’s camp hoped to persuade Churchill Downs to negotiate a settlement, relieving his owners from having to give his horses to other trainers or risk losing the Kentucky Derby. Not only is the race prestigious, but the derby winner increases the potential value of his horse by tens of millions.

The Medina Spirit’s death did not decide whether he would be allowed to win the derby. Baffert’s attorneys have challenged the test in federal courts, and the Kentucky Horse Racing Commission has yet to hold a hearing. At stake for horse owner Amr Zeidan is the first derby check for $1.8 million, which will be given to the owners of Al Mandaloun, the second-placed, if Spirit City’s win is voided.

The coach’s reputation and broader future in the sport hang in the balance. This month, the New York Racing Association will seek to suspend Baffert from its tracks in front of a hearing officer.
